Terms related to settlement

Terms of Use (User’s side)
This agreement (hereinafter referred to as the “Terms”) applies to all customers who use Spice Rent-A-Car Kawaguchiko (hereinafter referred to as the “Service”). PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SERVICES.

Article 1 (Definition)
In this agreement, the meaning of the terms listed in the following items shall be as specified in each item.

(1) [API – Application Programming Interface]
An Application Programming Interface for providing payment services on the Service.
(2) [Payment Service]
This is a service that allows you to settle the contract between the customer and us by credit card payment or convenience store payment.
(3) [Payment Service Provider]
A company that provides payment services.
(4) [Credit card Payment]
By using a credit card, payment is made by a credit card company, etc.
(5) [Convenience Store Payment]
At a convenience store, payment is made by paying a prescribed amount stated on a payment slip, etc., based on a designated payment slip, etc.
(6) [Intellectual Property Rights, etc.]
Copyrights (including the rights of Articles 27 and 28 of the Copyright Act), patent rights, utility model rights, trademark rights, design rights and other intellectual property rights (including the right to apply for registration, etc.), ideas, know-how, etc.

Article 2 (Agreement of these Terms)
Customers shall use this service and payment services in accordance with these Terms, and unless they agree to these Terms, they may not use those services.

Article 3 (Status, etc. of Payment Service Provider)
The Payment Service Provider shall not act as a party, agent, intermediary in the contract between the Customer and the Company.
The Payment Service Provider shall handle all communications, inquiries and other negotiations (hereinafter referred to as “Negotiations”) between the customer and the Company, as well as complaints, troubles and other disputes (hereinafter referred to as “Disputes”). The Company shall not be involved in any way and shall not be held responsible for any matters mentioned.
The Customer may make inquiries to the Payment Service Provider only through the prescribed methods, and the Payment Service Provider shall be able to respond to such inquiries based on its own judgement and discretion. However, the Payment Service Provider is not obligated to respond to the customer requests.

Article 4 (Receipt agent)
The Customer agrees in advance that the Payment Service Provider or a person entrusted by the Payment Service Provider will receive the payment for this Service paid through the payment services on behalf of the Company.

Article 5 (Use of the API – Application Programming Interface)
The Customer may use the API provided by the Payment Service Provider within the scope of the purpose of settlement of payments related to the contract between the Customer and the Company (hereinafter referred to as the “Purpose”).
The Customer shall not use the payment service outside the scope of this Purpose.

Article 6 (Attribution of rights)
All intellectual property rights, etc. related to the payment services belong to the Payment Service Provider or a person who has granted a license to the Payment Service Provider. It does not mean licensing, assignment or transfer of the intellectual property rights of the person granting the license.
Regardless of the reason, the Customer shall not engage in any act that may infringe the intellectual property rights of the Payment Service Provider or the licensee of the Payment Service Provider (including disassembly, de-compilation, reverse engineering, etc.)

Article 7 (Handling of information, etc. related to the use of payment services)
Customer terminal information, etc. (including, but not limited to, application launch logs and browser browsing logs), payment-related information, and other related service usage information (hereinafter referred to as “Payment Service Usage Information, etc.”) shall be handled in accordance with the privacy policy separately established by the Company and the Payment Service Provider, and the Customer consents to the handling of such information by the Company and the Payment Service Provider in accordance to such privacy policy.
The Company and the Payment Service Provider may use the Payment Service Usage Information, etc. at their own discretion for the purpose of providing and operating payment services, and improving service content, etc., or statistical information in a form that cannot identify individuals. The Company and the Payment Service Provider shall be able to use and publish it as general information.
The Company and the Payment Service Provider may use cookies or information collection modules to collect the Payment Service Usage Information, etc., in order to understand the usage status (including the purpose of retargeting advertisement distribution). The Company and Payment Service Provider shall not be held responsible for any damages caused by the use of cookies and information collection modules.
The Company and the Payment Service Provider shall not be obligated to store the Payment Service Usage Information, etc. even if such information is stored for a certain period of time for operation purposes, and may delete such information at its discretion at any time. Even such deletion causes damage to the customer, the Company and the Payment Service Provider shall not be held responsible.

Article 8 (Prohibited Acts)
In using this Service and settlement service, the customer shall not perform any of the following acts by him/herself or a third party, and shall not perform any of the following acts directly or shall not indirectly cause or facilitate.
Fraud or similar acts against the Company or the Payment Service Provider;
Actions that hinder or disrupt the business of the Company or Payment Service Provider (including obstruction of business, provision of false information, and falsification of information).
Acts of using this Service and payment services for illegal or unfair transactions;
Acts of using payment services for purposes other than payment for service provision;
Acts that exploit unintended bugs of payment services or use, create, or distribute external tools that have unintended effects;
Acts that impose an excessive load on the network or system, etc.;
Acts of providing benefits to anti-social forces, etc.;
Acts related to criminal acts or acts contrary to public order and morals or laws;
In addition to preceding items, acts that violate laws and regulations, court judgements, decisions or orders, or administrative measures that are legally binding, or acts that encourage or threaten to do so;
Acts that go against the intent and purpose of these Terms and payment service;
In addition to preceding items, acts that the Company and the Payment Service Provider deems inappropriate.

Article 9 (Disclaimer and Disclaimer of Warranty)
The Company and the Payment Service Provider shall ensure that the Service and payment service meet the Customer’s specific purpose, have the expected commercial value, accuracy, usefulness, and completeness, and comply with the laws and regulations applicable to the customer. We do not guarantee that it will comply with the internal rules of industry associations and that there will be no defects.
Customers agree in advance that bugs, malfunctions, and unusable situations may occur due to changes in communication conditions, and other external circumstances in the environment in which this Service and payment service are used.

Privacy policy

T.M.Works Co., Ltd. (hereinafter referred to as “we/our/our company/company”) and the service provided by “Spice Rent-A-Car Kawaguchiko Store” (hereinafter referred to as “this/the service”) to customer (hereinafter referred to as “you/user”). The information will be as follow.

Article 1 (General Rules)
We will comply with the Personal Information Protection Law, guidelines of each ministry and other related laws and regulations in order to protect user information (general term for information obtained from user).
The “Spice Rent-A-Car Kawaguchiko Store” privacy policy (hereinafter referred to as “this policy/policy”) applies to the use of this service (including the service provided by our company in association with this service). In addition, when our company stipulates the handling of user information in the privacy policy and other personal information protection policies posted on the website operated by our company, or the terms of use regarding this service, such provisions shall also apply. Article 2 (Information acquired by the Company and its acquisition methods)
In this service, we will acquire user information including personal information (referred to as “personal information” defined in Article 2, Paragraph 1 of the Personal Information Protection Law, and the same shall apply hereinafter) as specified below.
Information provided to users
We collect information such as user’s name, address, telephone number, email address, bank account information and credit card number.
Information we collect when using this service
Terminal information
When a user uses our service on a terminal or mobile terminal, we will maintain and improve this service, or in order to prevent fraudulent activities, we will identify the terminal-specific information (individual identification such as terminal-specific ID information, etc.) used by the user may be collected.
Log information and action history information
In order to maintain and improve this service or prevent fraudulent activities, we will collect information on IP addresses that are automatically generated, will save the date and time of requests from users and operation history when using this service if necessary.
Cookies and anonymous ID
We may use cookies and similar technologies in this service. Cookies are a standard technology that allows web servers to identify your computer. Location information

Payment information
When you purchased products within this service, we will obtain the payment information required for payment processing. If a third-party payment provider processes your purchase, we may obtain billing and payment information provided by you to the third-party payment service company.
We will properly acquire user information without any deception or other improper means. In addition, when user information is acquired by a method other than acquisition by using this service, we will in advance notify or inform the purpose of use.

Article 3 (Purpose of use)
We will properly handle the user information acquired through the use of this service within the scope of the following purposes. We will not use it beyond the scope of the purpose of use without the consent of the user.
The Company may change the purpose of use set forth in the preceding paragraph to a reasonable extend recognized as having a considerable relevance to the purpose of use. Before the change, and in the event of a change, the user will be notified or informed to use a method separately determined by the Company.

Article 4 (Provided by a third-party)
We will not provide user personal information to third-parties except mentioned in Article 3 and the following cases.
With the consent of the user
When required by law
When the user acts or attempts to violate the terms of use in this service, such as harming the interests of others or violating public orders and morals in using this service. The Company will take necessary measures against such acts
When it is necessary to protect the life, body or property of a person and when it is difficult to obtain the consent of the person
When it is particularly necessary to improve public health or promote the sound development of children, and it is difficult to obtain the consent of the person.
When it is necessary for a national institution or a local body or a person entrusted with it to cooperate in carrying out the affairs stipulated by laws and regulations. When there is a risk of exerting, obtaining the consent of the person will hinder the process of the affairs
When business succession including user’s, personal information is made due to merger, company split, business transfer or other related reasons
We provide affiliated services (hereinafter referred to as “affiliated services”) (hereinafter referred to as “affiliated partners”) to businesses that provide services affiliated with this service. With the consent of the user, we shall be able to provide user information including personal information.

Article 5 (Consignment of handling of personal information)
The Company may outsource the handling of all or part of the personal information obtained from the users to a third-party (such as a contractor that handles information including personal information for a business operator). In this case, the Company will conclude a confidentiality agreement, etc. with the contractor in accordance with this policy in advance, and will supervise the contractor as necessarily and appropriately so that the information can be properly managed.

Article 6 (Shared use)
We may share personal information obtained from users with our affiliated partners and other third-parties that provide affiliated services to this service. In this case, the Company will inform in advance the name of the affiliated partner or third-party, the purpose of shared use and the type of information to be shared.

Article 7 (Safety management system)

Article 9 (Change of this policy)
The Company shall review the operational status regarding the handling of user information as appropriate and strive for continuous improvement, and may change this policy from time to time as necessary.
We will notify you of the changed of policy by posting it on this service or on the website operated by our company or by other easy to understand methods. However, when making changes that require the consent of the user by law, we will obtain the consent of the user by a method separately determined by the Company.
